Is tax due on money from an OFE or ZUS sub-account after a death?

A cash payment from an OFE or a ZUS sub-account after the member’s death is income taxed at a flat rate of 19%. The fund or ZUS acts as the withholding agent: it deducts the tax and transfers the net amount, so the recipient does not report it in the annual PIT return or pay anything extra. Transferring half of the funds to the spouse’s sub-account or OFE account is not a payment and is not taxed; tax arises only when the spouse’s own pension is paid in future. Acquiring these funds is not subject to inheritance and gift tax, so no SD-Z2 form is filed.
