The division has two stages. First, ZUS transfers to the spouse’s sub-account half of the funds accumulated during the marital community of property, by transfer only, never in cash. The remaining part is paid to the beneficiaries the deceased designated at ZUS or at their open pension fund (OFE), in cash or by transfer. Without a designation the funds fall into the estate and ZUS pays them to the heirs on presentation of a court order or a notarial certificate of succession. The application is filed on form USS. If the deceased belonged to an OFE, the fund starts the division and ZUS splits the sub-account in the same proportions.
