The circle follows from Article 691 of the Civil Code and does not depend on inheritance or registered residence. There is one condition: permanent residence in the flat until the tenant’s death. The entitled person files with the municipality an application to confirm succession to the tenancy, with the death certificate, documents proving the relationship and evidence of residence. There is no income criterion. If the municipality refuses, a court action to establish succession to the tenancy remains. Siblings, parents and grandchildren do not succeed unless the tenant had a maintenance obligation towards them.
